1. Introduction

Welcome to Cekolah, a multi-tenant school management platform provided by PT. Pintar Manajemen Sekolah ('Cekolah', 'we', or the 'company'). By accessing and using Cekolah services, you agree to comply with these Terms & Conditions.

If you do not agree with these terms and conditions, do not use Cekolah services.

2. Acceptance of Terms

By registering an account or using Cekolah services, you declare that:

• You have read, understood, and agreed to these Terms & Conditions
• You are at least 18 years old or have parental/guardian consent
• You have legal capacity to bind yourself in a contract
• The information you provide is true, accurate, and complete

3. Service Description

Cekolah provides a SaaS (Software as a Service) school management platform with the following features:

• Management of student, teacher, and staff data
• Academic management (schedules, assignments, grades, reports)
• Finance and tuition payment management
• Online student registration system
• Announcement and blog management
• School page customization
• Communication system between school, students, and parents
• Multi-tenant management with per-school data isolation

We reserve the right to add, modify, or discontinue service features at any time with prior notice.

4. User Accounts

4.1 Account Registration

To use Cekolah services, you must:

• Create an account with true and complete information
• Provide a valid email address

4.2 Account Responsibilities

You are fully responsible for:

• Maintaining the confidentiality of your password and account credentials
• All activities that occur under your account
• Immediately notifying us if there is unauthorized account use

We are not liable for losses resulting from your negligence in maintaining account security.

4.3 Suspension and Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms & Conditions
• You use the service for illegal or harmful activities
• You fail to pay due subscription fees
• Your account is inactive for a certain period of time

5. Multi-Tenant Usage

Cekolah uses a multi-tenant architecture where each school operates as a separate tenant:

• Each school (organization) has its own domain (e.g., sekolah.cekolah.com)
• Each school's data is isolated and cannot be accessed by other schools
• Schools are responsible for their students' data compliance with applicable regulations
• Schools can configure user access rights (RBAC) according to their needs
• Cekolah is not responsible for conflicts between users within a school

6. Payment Terms

6.1 Subscription Fees

Cekolah offers subscription packages with different fees. Subscription fees include:

• Organization creation fee (school setup)
• Monthly or annual subscription fees
• Fees for additional features or upgrades

6.2 Payment Methods

We accept various payment methods including:

• Bank transfer (BCA, Mandiri, BNI, etc.)
• Credit/debit cards
• E-wallets (GoPay, OVO, Dana, etc.)
• QRIS

6.3 Tuition Payments

For student tuition payments:

• Schools set tuition amount and payment schedule
• Student parents/guardians pay through the Cekolah platform
• Cekolah provides a secure and integrated payment system
• Transaction fees may apply according to payment gateway policy

7. User Responsibilities

As a Cekolah user, you agree to:

• Use the service only for lawful and legitimate purposes
• Respect the rights of others and not commit violations
• Not upload illegal, harmful, or copyright-infringing content
• Not engage in hacking, spamming, or other security attacks
• Protect the confidentiality of student data and other information under your access
• Report security issues or bugs found responsibly

8. Intellectual Property Rights

8.1 Cekolah Intellectual Property

All intellectual property rights related to the Cekolah platform, including but not limited to:

• Software code and algorithms
• Interface design and user experience
• Logos, trademarks, and branding
• Documentation and marketing materials

are owned by PT. Pintar Manajemen Sekolah and protected by Indonesian copyright law and international agreements.

8.2 User License

We grant you a limited, non-exclusive, non-transferable license to:

• Access and use the Cekolah platform according to subscription terms
• Store content you create or upload on the platform

This license ends when your account is terminated or you stop subscribing.

8.3 User Content

You retain rights to content you create or upload (student data, teaching materials, etc.). However, you grant us a license to:

• Store, process, and display content to provide the service
• Analyze content to improve the service
• Perform backup and recovery of content

9. Limitation of Liability

To the extent permitted by applicable law:

• We are not liable for indirect, incidental, special, or consequential damages (including loss of profits, data, or use)
• Our maximum liability does not exceed the amount of subscription fees you have paid in the last 12 months
• We do not guarantee that the service will be free from interruptions, errors, or viruses
• We are not responsible for content created by other users or schools

10. Governing Law

These Terms & Conditions are governed by and construed in accordance with Indonesian law. Any disputes will be resolved in the competent courts of Yogyakarta, Indonesia.

Relevant Indonesian regulations include:

• Law No. 27 of 2022 on Personal Data Protection (UU PDP)
• Law No. 11 of 2008 on Electronic Information and Transactions (ITE)
• Law No. 19 of 2016 amending Law No. 11 of 2008 on ITE
• Law No. 8 of 1999 on Consumer Protection
• Kominfo Electronic System Provider (PSE) Regulations

11. Dispute Resolution

If a dispute arises related to Cekolah services:

• We are committed to resolving disputes through good faith negotiation in writing
• If no agreement is reached within 30 days, the dispute may be brought to mediation or alternative dispute resolution institutions (LAPS)
• If still unresolved, the dispute will be resolved in Yogyakarta courts

12. Service Termination

12.1 Termination by User

You may stop using the service and close your account at any time:

• Contact Cekolah support for account closure request
• Data will be deleted according to retention policy after subscription period ends

12.2 Termination by Cekolah

We may terminate the service with 30 days' notice if:

• The service can no longer be operated commercially
• Regulatory changes require service termination

We may terminate the service immediately without notice if:

• You seriously violate the Terms & Conditions
• You use the service for illegal or harmful activities

13. Changes to Terms & Conditions

We may update these Terms & Conditions from time to time. Significant changes will:

• Be announced via email or notification on the platform
• Take effect 30 days after notification
• Continued use of the service after the notice period is deemed acceptance of changes
